In accordance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals, this Privacy Notice is issued in the following terms:
Who is responsible?
Xharing, Inc. ("Xharing"), is responsible for the use and handling of your personal data.
Any questions, comments, notifications and/or complaints regarding the handling of your personal data can be directed to the e-mail address privacidad@xharing.com.
What information do we collect and what do we use it for?
To create an account in Xharing, the user must provide data such as name, e-mail address and/or cell phone number, as well as a password.
The profile that is created for each user may include company, physical address, photograph and other information, but this information is not mandatory.
The professional and contact information shared by users is used by them to interact with their network of contacts and exchange information. Users can even allow that some of the data shared by them may be available to people who have not registered in Xharing.
Through the address book and calendar synchronization option, the user allows Xharing to obtain the information contained in the address book and calendar to increase the size of the network and facilitate communication between Xharing users through their cellular and/or mobile devices.
Xharing logs data using the application and Xharing services in general, including websites, logins, devices and Internet Protocol ("IP") addresses for identification and registration of users.
The data provided by users and collected by Xharing will be used for: (i) identification and registration of users and/or customers, (ii) validation of their data, (iii) password creation and recovery, (iv) data updates, (v) synchronization of information from the application with the user's device, (vi) synchronization of the user's data and the information provided with your organization's information and (vii) contacting the customer by means of notifications to their device to give notice of information updates, from third parties or from the application.
On the other hand, Xharing may also use the data to notify the user about new products or services, send advertising and to send invitations and notices of promotions, unless the user, within five business days following its registration, expresses the refusal to the treatment of its personal data for the secondary purposes mentioned in this paragraph, by means of a notice to the e-mail: privacidad@xharing.com.
Xharing undertakes to process the personal data only and exclusively for the purposes approved by the owner, as well as to establish and maintain the security controls for the protection of the same.
Xharing may transfer the data to entities of the same interest group, as well as to governmental agencies, in order to comply with the purposes for which you have provided your data. Xharing at all times takes measures so that the third party receiving the personal data adheres to compliance with this privacy notice, and undertakes to transfer the personal data solely and exclusively for the aforementioned purposes.
Regardless of the location, origin or place of use of Xharing, the processing is subject to the limits arising from the nature of the personal data, the provisions of the General Data Protection Regulation of the European Union, the Federal Law on Protection of Personal Data Held by Private Parties (Mexico) and the Statutory Law 1581 of 2012 (Colombia).
How to limit the use of information?
The user has the right to limit the use and disclosure of their information by submitting a request via email to privacidad@xharing.com. The use or disclosure of users' personal information cannot be limited when it is necessary to comply with legal obligations or requests from competent authorities.
Consent
All visitors to the Xharing platforms must register and authorize the processing of personal data in order to make use of the services offered. Therefore, in each of the systems there is a box that says "Privacy Policy and Processing of Personal Data" which must be read and accepted in order to continue with the use of Xharing services.
Arco Rights and Revocation of Consent
The user has the right to know what personal data Xharing keeps, what Xharing uses them for and the conditions of use (Access). Likewise, it is your right to request the correction of your personal information in case it is outdated, inaccurate or incomplete (Rectification); that Xharing remove it from its records or databases when you consider that it is not being used in accordance with the principles, duties and obligations set forth in the regulations (Cancellation); as well as to oppose the use of personal data for specific purposes (Opposition). These rights are known as ARCO rights. Likewise, you may revoke the consent you have given us.
To exercise these rights, as well as the revocation of consent, you must submit a request via email to privacidad@xharing.com.
Use of "Cookies" and "Web Beacons".
With the objective of improving the experience of its users in the application and on the Internet sites, Xharing may use "cookies" and/or "web beacons", by obtaining personal information of the users, such as the Internet pages you visit, the links you follow and the IP address.
These cookies and other technologies can be disabled by the user through the configuration of the respective application and/or browser.
Changes to the Privacy Notice
We reserve the right to make changes or updates to this Privacy Notice at any time, in order to comply with new legislation, internal policies or new requirements for the provision or offering of our services.
Improper Processing of your Personal Data
If the user considers that his right to protection of personal data has been injured by any conduct on the part of Xharing, or in its actions or responses, he presumes that in the treatment of his personal data there is any violation of the provisions of the Federal Law for the Protection of Personal Data in Possession of Private Parties, he may file the corresponding complaint or denunciation before the National Institute of Transparency, Access to Information and Protection of Personal Data (INAI, for its acronym in Spanish).
